Abstract
In this article, I define encroachment, discuss the relevant legal theories, and review the various legislative and regulatory approaches to the problem. Next I explore the approach by franchisors and various trade associations in addressing the issue. Finally, I discuss some possible strategies to avoid encroachment problems.
